These Terms of Service (“Terms”) govern your access to and use of the website, services, products, and ordering systems of Custom Phenolic Labels, a division of Mike’s Trophies & Awards of Atlanta (“Company”). By accessing or using the Custom Phenolic Labels website or placing an order, you agree to these Terms. If you do not agree, do not use this site or place orders.

Custom Phenolic Labels provides custom engraving and industrial identification solutions, including:

Services include quoting, engraving, packaging, and delivery of finished products as ordered by customers. Custom Phenolic Labels ships to all 50 U.S. states and select international locations.
2. Acceptance of Orders
2.1 Quote Requests
Quotes are prepared based on information and files submitted by the customer. It is your responsibility to provide accurate, complete data, including material type, text content, dimensions, colors, mounting preferences, and quantities.
2.2 Order Confirmation
A contract is formed only when Custom Phenolic Labels sends a formal order confirmation or accepts payment, whichever occurs first. All quotes are non-binding estimates until that point.
2.3 Proof Approval
For orders requiring proofs (custom shapes, logos, or complex layouts), you must provide explicit written approval before production begins. Custom Phenolic Labels is not responsible for engraving errors that match an approved proof.
3. Pricing and Payment

Prices are based on material selections, quantities, engraving complexity, and any additional services such as sorting, kitting, blind shipping, or special mounting configurations.

3.3 Taxes and Duties
You are responsible for all applicable sales taxes, import duties, and fees unless a valid tax exemption certificate is provided to Custom Phenolic Labels before the order is invoiced.
4. Intellectual Property and Proprietary Files
4.1 Ownership of Uploaded Files
You represent and warrant that you own or have the legal right to use any files, drawings, logos, or data submitted to Custom Phenolic Labels. By uploading files, you grant Custom Phenolic Labels a limited, non-exclusive license to use those files solely for the purpose of quoting and producing your order.
4.2 Confidentiality
Custom Phenolic Labels treats all uploaded files as confidential. Custom Phenolic Labels does not sell, share, license, or distribute your files to third parties except as necessary for order fulfillment (e.g., shipping carriers).
5. Delivery and Risk of Loss
5.1 Shipping
Products are shipped via the carrier selected at the time of order. Delivery dates provided by Custom Phenolic Labels are estimates. 5.2 Risk of Loss
Risk of loss or damage passes to you when the carrier takes physical possession of the shipment at the Custom Phenolic Labels facility. Custom Phenolic Labels will assist with carrier claims for shipments damaged in transit when reported promptly.
6. Returns and Refunds
All products manufactured by Custom Phenolic Labels are custom engraved to order. Returns and refunds are not accepted once production has begun. If Custom Phenolic Labels makes a manufacturing error (incorrect text, wrong color, or layout discrepancy compared to the approved order), Custom Phenolic Labels will remake the affected items at no cost. 7. Warranty and Limitations of Liability
7.1 Product Warranty
Custom Phenolic Labels warrants that all products will conform to the specifications and descriptions confirmed at the proof or order confirmation stage. This warranty does not cover damage resulting from misuse, unauthorized modifications, improper installation, or environmental exposure outside the specified parameters of the material.
7.2 Limitation of Liability
In no event will Custom Phenolic Labels be liable for indirect, incidental, special, or consequential damages, including lost profits, project delays, or loss of data, even if advised of the possibility of such damages. The maximum liability of Custom Phenolic Labels for direct damages shall not exceed the total amount paid by you for the specific products in dispute.
